TERMS AND CONDITIONS

Definitions:

'You' - the person whose name appears on a course booking received by Getsmart through email, telephone or  this website.

'Course booking' - refers to a valid course booking, which is constituted on the date that Getsmart's bank account reflects payment received from You.

 

1. Course Fee

Getsmart Financial Training Ltd (referred to as "Getsmart" hereafter) reserves the right to change the amount of the course fees from time to time. In the unlikely event that due to a technical error, the amount of the Fee displayed on the Website is incorrect, Getsmart will contact you as soon as possible to inform you of the error. If the incorrect amount is lower than the correct amount, you will need to settle the difference. If the incorrect amount is higher than the correct amount, Getsmart will refund you the difference.

 

2. Course Booking

Your course booking is only secured once Getsmart has received cleared funds from you or your employer (if you select to invoice your employer) in respect of the course fee for the relevant course.

Due date for payment:

- If you are responsible for paying the fee, due date is the date the course is booked; or

- If your employer is responsible for paying the fee, due date is within 30 calendar days from the date of the invoice made out to your employer; or

- If course booking is made less than 30 days before the course start date, payment is due immediately.

Without prejudice to Getsmart's rights and remedies, Getsmart reserves the right, forthwith and at Getsmart's sole discretion, to cancel your course booking and refuse you entry to the relevant Course should full payment not be received in cleared funds on or before the due date in accordance with the terms set out above.

 

3. Cancellation or Deferral

Informing us of cancellation or deferral

Note: any refunds issued by Getsmart will be for an amount as described below, less the Paypal commission amount which had been incurred by Getsmart on receipt of your initial payment.

3.1 You must inform Getsmart of your decision to cancel or intention to defer a booking by emailing This email address is being protected from spambots. You need JavaScript enabled to view it. within the Cancellation Period (where the "Cancellation Period" is within 14 calendar days after booking was made, where the booking date is the date of cleared funds received by Getsmart for your booking).

3.2 Should your notice of cancellation or deferral be received:

3.2.1 outside the Cancellation Period, and more than 30 days prior to the course date, you will be entitled to an amount of the course fee you paid less £110 administration fee.  This amount will be issued by Getsmart either as a refund or a credit note (which you can use to book another course).

3.2.2 within 30 days prior to the course date (whether within or outside the Cancellation Period), you will not be entitled to any amount for refund or a credit note. In such instances, Getsmart reserves the sole right to use its discretion whether to issue any refunds, credit notes and/or allow deferrals.

3.2.3 Getsmart reserves the right to use its discretion to determine whether to issue any refunds, credit notes and/or allow deferrals in exceptional circumstances which fall outside clause 3.2.1 and 3.2.2 and to charge additional fees in any such event.

Getsmart will pay the relevant amount for refund into your bank account within 14 days after Getsmart receives notice of your banking details per email.

 

Cancellation rights

3.4 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“Consumer Contracts Regulations”) you may cancel your purchase of the course within a period of 14 calendar days (“Cancellation Period”) from the date on which the contract is concluded subject to Clauses 3.4.1 and 3.4.2 below.

3.4.1 Your right to cancel and obtain any refund will be lost if you have given Getsmart express consent to supply any services during the Cancellation Period and the service has been fully performed by Getsmart. This is the case where for example a course booking is made 14 days or less before the course date, and then subsequently the booking is cancelled by you. You will not be able to receive a refund in such a case.

If you have given express consent to Getsmart to perform during the Cancellation Period but the service has only been partly performed by Getsmart, you will be liable to pay for the services actually received.

3.4.2 If the contract is for the supply of digital content, including but not limited to online courses, webinars, online study materials etc, your right to cancel and obtain any refund will be lost if you have given Getsmart express consent to supply the digital content to you during the Cancellation Period or if you access the digital content before the expiry of the Cancellation Period.

3.5 Getsmart reserves the right to cancel a course at any time up to one working day prior to the commencement of such course. If Getsmart cancels a course, you will be entitled to a refund of the course fee you paid.

 

Changing your booking from one course type to another

3.6 Should you wish to change your booking to attend a different type of course than your booking was made for, an administration fee of £110 will be applicable and payable by you.  

3.7 Getsmart reserves the sole right to use its discretion whether to reduce any penalties or administration fees mentioned above.
